Verizon Appealed my Federal Judges Decision to grant me a trial – Part of Verizon’s Games of Denying Justice to their Victims!

It was 1 year ago, I sat face to face with Verizon and Verizon assured me that I would “NEVER” see the court room and justice would never be granted to me, they would not allow it to happen. They assured me that they (being Verizon) had unlimited resource to deny me and my family (VICTIM’S of Verizon’s continues abuse of now 8.5 years) of JUSTICE. The extent of their bullying tactics were not surprising, it was expected.

Verizon is still trying their best to continue to hold down their VICTIMS all over the country, and continue to beat them into the ground until they DIE or go away. I will not go away nor will I fall to them.

Verizon as Mighty and Financially Powerful as they are will spend Trillions of their shareholders and investors money yearly defending their inappropriate perpetrators allowing them to foster and grow within their company. Verizon allows the behaviors to manifest and become the norm. They continue to cover-up their inappropriate acts, instead of repairing them making it a better well groomed company. Instead they train how to Bully, then reward and protect for the bad behaviors.

Within two weeks of my Federal Court Judge deciding in my favor (based on overwhelming evidence against Verizon), Verizon now appealed the Federal Court Judges Decision to grant me a trial. The ignorance of Verizon, to tell a Federal Court Judge that, he was WRONG! Then subsequently denying me my right, to state my story to my jury of peers!

Verizon will continue to try and deny justice to unfold. Verizon has the money to keep this process flowing, even though they know I am right.

Martin Luther King once said, “Injustice anywhere is a threat to justice everywhere.” He wrote this in a letter from the Birmingham Jail, April 16, 1963. The issue here is that companies like Verizon with large sums of money, will do whatever it takes, to squish the no bodies like us. They feel we do not matter as people, and we cannot outlast them, that were until they met me. It is unjust that I deserve justice for what Verizon did and allowed to happen to me. It is unjust how I have read, and personally spoken to so many thousands that have had injustice at Verizon. Such a huge company and so many hate them for what they have done to them, their family, friends or neighbors. I have heard it all, and the stories never end.

I am going to take them down I will not be denied any form of injustice. I will help others do the same. As Victims of Verizon – we all have been sharing notes, passing on others depositions, other case, exchanging ideas and building upon something larger that ourselves, it will all work out.

I have God, my family and so many of you. Let Verizon spend all they have, but I was already awarded trial twice, so in know my justice system is working for me.

NY Disability Attorney Files Class Action Lawsuit Against Verizon for Potential Cancer Victims

As detailed in Newsday today, Mitchell Breit of the national class action law firm of Whatley, Drake & Kallas and the disability law firm of Turley, Redmond & Rosasco have filed a “medical monitoring” class action lawsuit against Verizon in New York Supreme Court, County of Brooklyn, for workers who previously worked at the former Sylvania nuclear fuel rod plant in Hicksville, Long Island. Verizon previously settled a lawsuit by surrounding residents for a reported 11 million dollars due to an increased rate of cancer in the area.

The lawsuit follows a recent decision by the New York State Workers’ Compensation Board which found that a worker on the site, Gerard DePascale, developed a rare and deadly cancer (extra-skeletal myxiod chondrosarcoma) as a result of exposure to toxins on the site. In addition, a recently released Army Corp of Engineers report found danger to the public by this still contaminated site. Despite special federal funding won by Senator Chuck Schumer for a complete clean-up of the site, legal wrangling between Verizon, the Army Corp and the New York State Department of Environmental Protection have put a stop to the clean-up. How many more people have to come down with cancer before Verizon does the right thing?

The lawsuit seeks to force Verizon to set up a “medical monitoring” fund so that the thousands of workers who were unknowingly exposed to the toxins on the site can benefit from early diagnosis and treatment of any potential medical problems. As detailed in the Newsday story today, workers like Robert Matteo are mad that they were never told of the dangers on their work site.

Unfortunately, Gerard DePascale, whose cancer has now spread to his lungs, is still waiting a final ruling from the New York State Workers Compensation Board. Despite winning his case in front of trial judge Abigail Chanis in March 2007, his employer appealed the judge’s decision. He has now been out of work with no workers’ compensation benefits since January 2006! The abnormally long delay in deciding this appeal is causing the DePascale family severe financial hardship. Thankfully, with new leadership at the Workers’ Compensation Board, a decision in Mr. DePascale’s case hopefully will be expedited.

N.Y. gunman described as quiet, friendly neighbor

On Friday morning a 58 year old man in New York by the name of Jeffrey Johnson, returned to his place of business that he was fired from just one year ago, and killed a 41-year-old Steve Ercolino, a former Hazan colleague.

I listed through that day and into Sunday morning August 26th and very few still don’t have a clue.

It is normal and right for us all to feel for the victim and the bystanders that were hurt and killed in the cross fire. My heart and prayers go out to them. But it is time we get to the answers of why this happened? It is the only way we can help, stop this from happening.

Usually those hidden answers get crowed up by the gun and non-gun controllers. It gets twisted in the overwhelming media blitzes and people making all kind of assumptions and guesses.

All too often we listed and not hear, but it is not the voices we need to hear to receive the answers we need to seek – for this puzzled situation. The answers to why this happened were right in the minutes following the murder at the Empire State Building on Friday morning on August 24, 2012.

Every paper, every radio and news station was claiming that Mr. Johnson Returned to his former employment after a year of getting let go. They stated that he was let go from his position a year ago. Just like me and many others, the companies try to cover up their malicious ways of getting rid of a targeted employee in what they call a “RIF – Reduction in Force.”

Mr. Johnson returned one year later because there was a great possibility that his life fell apart in so many ways. He got seriously depresses, and he had nothing to live for. As he sat there in his home / apartment he consistently found himself thinking of the person that help to manifest this failure in his life.

When I heard he returned one year later, I knew how he felt and what he was thinking. I knew in my mind that this man was some how involved in some type of bulling at work, and was targeted, then let go. I felt a strong possibility that Mr. Steve Ercolino and Mr. Johnson had some bad blood at the employment and this was one or many years of the build up animosity, and Mr. Johnson just could not take it anymore. I do not know what he was going through financially but when you are in a financial hardship, and you know it was caused by others as you were a targeted person, let go for unjust reasons, it’s very hard to accept you and your family’s lives crumbling around you and not want to act out. I can understand his emotional thought process, but I will never accept violence as the answer. I have been there, but decided to out reach to help others in Mr. Johnson and my situation not to result to any form of Violence.

Workplace Bulling, will continue to destroy lives each day, in more ways than anyone wants to admit it. What Mr. Johnson did, hundreds to possibly thousands “THINK” of doing to their Bullying Managers / Co-Workers each day. Few actually act out as they come to reason, or they feel it’s not worth it. But the ones that have nothing to loose as they have nothing, these targeted victims of workplace bullying will act out.

I know, because I have lived in Mr. Johnsons shoes. I am so sorry for Mr. Jeffry Johnson and Mr. Steve Ercolino, as they were having issues at work, reporting them and “NOTHING” was done about it. Both families are destroyed because of NEGLECT.

I worked at Verizon and companies like Verizon often Neglect to stop their perpetrators’ from acting out in a malicious manner with intent to harm and or destroy lives.

Just like at Verizon, there are many ongoing criminal acts, workplace bullying, racism, sexual harassment, a manifested hostile work environments and so many other immoral and unethical issues that go on, reported and ignored. Verizon’s EEOC has reported that they receive over 104,000 complaints a year, that’s not including so many other unreported issues that Verizon employees are afraid to report due to retaliation. Verizon is no different than other companies as well, and this cannot go on any longer. How many more people have to get killed at work, how many more good employees have to have emotional breakdowns, how many more people have to kill themselves and how many more lives have to be destroyed before we say: “Enough is Enough – Stop Workplace Bullying?”

On Friday August 24, 2012 I felt compelled to add a comment on an article that was posted in Yahoo. The headline and article said:

People often wonder why someone would do this? Why would this man return to a job 1 year later and kill as person he worked with? We often are shocked by the outcome, but there are unanswered questions. Someone said he was fired so what? Well we do not know how much this man suffered while working with this company and apparently by this other person? We do not know how bad his life sunk because of what he lost? Apparently he was pretty pissed off to shoot someone in the head. This without a doubt is very tragic and sad, but we as a nation need to understand that this is often a result of Workplace Bullying. In schools children kill themselves, in corporate America, workers kill their former employees. When we decide to make Workplace Bullying a law, acts like these will begin to decrease. “Enough is Enough – Stop Workplace Bullying” and stop violent acts like this.

What made me get up today and write this to you was only two days later I saw what I had already felt. Mr. Jeffry Johnson and Mr. Steve Ercolino had long issues at work, and it was reported. So much more will come of this investigation but the facts were there.

Something was done though, and based on the outcome of this death, we will possibly see that it was Mr. Jeffry Johnson was the victim in this Workplace Bullying, and was Wrongfully Terminated. He had no legal recourse as was not a part of a protected class, and there was NO law in effect to help this man out.

I have spoken on these exact issues in New York, Massachusetts and Connecticut, and in all three States, “The Healthy Workplace Bill” was not passed this past session. In fact the most recent speech I gave at the “Civil Rights and Anti-Bullying Leadership Summit in Hartford Connecticut at the Legislators Building, August 9, 2012” was exactly on employees killing their peers at work as a result of Workplace Bullying.

When shootings have workplace connections

Here we go again America – another gun killing. This time, the shooter, Jeffrey Johnson, targeted a specific individual, Steve Ercolino. He gunned him down outside the Empire State Building. Johnson was let go one year ago from Hazan Imports, a small firm that designs handbags, where Ercolino was VP of sales.

After Johnson shot Ercolino twice, he left the scene and was followed by construction workers. When the police reached Johnson, he pulled his gun and the police killed him.

This might be an incident in which the shooter was a former bullied target. In a 2012 WBI survey, 41% of bullied targets reported that they “understand how a person could be driven to hurting or killing those who had bullied them.” Most shootings don’t involve bullying or bullied targets. Here’s the basis for my speculation.

My speculation is based on two reported facts. CNN reported that two men had a long-standing dispute at work. Each had filed harassment claims against the other. Since they were both men, and unless there were racial differences between the two, the harassment would not have met the criteria for illegal discriminatory harassment. That would have made the claims about bullying, the form of harassment that is legal when both parties are the same gender or same race. So, there might have been bullying of one by the other at the root of their “dispute.”
The second important fact is that Ercolino was walking to work with Irne Timan. She saw Johnson emerge from hiding behind a white van when the two neared. Timan told the NY Times reporters: “I saw him pull a gun out from his jacket, and I thought to myself, ‘Oh my God, he’s going to shoot him’ — and I wanted to turn and push Steve out of the way,” Ms. Timan said, in a telephone interview from the precinct house where she was being interviewed. “I knew it; I just knew it was going to happen. But it was too late. Steve screamed, Jeff shot him, and I just turned and ran.”

Her report confirms the animosity Johnson felt toward Ercolino. In the aftermath, there will much soul searching about what could have been done differently at Hazan. Human resources should be asked to provide evidence they had tried to resolve the Johnson-Ercolino “dispute.”

Clearly, Johnson blamed Ercolino for his job loss. After a year with no work to fuel the resentment, Johnson made a decision he thought was the only option available to him. From the outside looking in, we know he had other options. But we were not in Johnson’s shoes. CNN’s lead sentence condemned the man as a “disgruntled former worker.”

Employers have the right to terminate based on economic necessity. But the methods of separation are worth considering prior to severing people. Layoffs can lead to destitution, lost homes, lost access to health care, strained family relationships. A little advance planning sprinkled with a dose of compassion could preclude standard resentments. Decisions have consequences.

Was Johnson given a severance? Was his unemployment denied? Was there no extension of benefits? Was he given bad references, making the next job impossible to get? We simply don’t know right now.

In the end, only Jeffrey Johnson was responsible for the tragedy he brought to the Ercolino and the families of all the people wounded in the process.

One day, a law will pass, so we can help to force adult to get along with each other, while at work. We can then help educated each company, on the repercussions of this terrorizing and destruction of an illness to out country, called Workplace Bullying. I know I have made it my passion to do so.

Verizon employees, over time I have been working endless ours behind the scenes on things that will create such a momentum for the rights and victims of Verizon’s abusive behaviors.

One of the most important things I had to do for the victims of Verizon was to seek out an attorney for you. This attorney will be a National Contact in the fight for justice against Verizon and for others for seeks assistance and justice. The attorney that I had to choose for you, not only have the intelligence, passion and heart to take on Verizon, but the guts that it really takes to do this job. Verizon is dishonest and will do just about anything they can do to lie in the process of destroying lives, the lives of their own employees. The same employees, which are working hard for Verizon’s profit which Verizon earns each day, off the backs of good hardworking employees. All these employees want is what I wanted, RESPECT!

Attorney Carol Ryder and I are working on something enormous which will make a major dent into Verizon throughout the country. This is not about revenge, it’s about justice and it’s about time!

Attorney Carol Ryder out of New York and I have teamed up on a project not only to help the victims of Verizon Workplace Bullying, but victims in other companies that are being bullied as well. We will start with Verizon as this is something we both are very passionate about as well as failure with. Having access to thousands of Verizon employees this will help to spread the word.

Attorney Carol Ryder and I are linking up with attorneys all over the country to unify this fight. A database will be created, similar to the one I will hopefully be building for the IBEW / CWA in the future. The database will document every case, and every abusive and unethical act across the country that has happened within Verizon. With this, well documented events, it will help many in their fight for justice against Verizon. It is sad that we have to waste out lives and time doing this, but Verizon has failed us all as it was their job to police their perpetrators but decided to cover them up instead.

I cannot go into great detail right now, as things are progressing. There is hope for the ones who feel they are beaten down by this monster and vicious company called “Verizon!”

What a Conference:

On Thursday I was interviewed for a documentary on Workplace Bullying and was a guest speaker at the “Civil Rights and Anti-Bullying Leadership Summit” in Hartford Connecticut. The event took place at the Legislators office Building on Capital Avenue.

Senator Len Suzio opened the Conference up and set the pace for the day.

The “Civil Rights and Anti-Bullying Leadership Summit” was sponsored by the Commission of Human Rights and Opportunities. It is co-sponsored by the “State of Connecticut on Human Rights and Opportunities and the Office of Protection and Advocacy for Person with Disabilities.”

This is just the beginning, as there is so much down the road. We will change things in the workplace – one step and a time.

Civil Rights and Anti-Bullying Leadership Summit:

I was recently invited to speak at the “Civil Rights and Anti-Bullying Leadership Summit” in Hartford Connecticut.  The Commission of Human Rights and Opportunities is putting this summit on.  It is co-sponsored by the “State of Connecticut on Human Rights and Opportunities and the Office of Protection and Advocacy for Person with Disabilities.”

This summit will take place this Thursday August 9, 2012.  This is such an honor for me, and an opportunity to share my personal experience once again to the world, about the effects of workplace bullying and what Verizon had done to me.

My personal experience at Verizon, has allowed me to help others all across this country, even though my family and I have suffered to so much.  Thursday I hope to continue to progress in this battle against Workplace Bulling, in hopes to one day pass the “Healthy Workplace Bill” in Law.

What an honor to be on the stage with some of the states most elite and professionals in this subject.

Justice in the End – A Victory for all.

By the grace of God, and the blessing from my father, 24 hours ago I was advised by my attorney that the Federal Court judge granted me a TRIAL!!

8 ½ years of fighting for justice against Verizon for unethical and immoral treatment, justice is finally here.

Just 1 year ago, Verizon assured me that I would NEVER see the court room or justice, it was granted!!!!

This VICTORY against a HOSTILE company like Verizon is a WIN for so many that could not go the distance.  It is for all of the people each day that go to work is so many companies with the best intentions, only to be demoralized and abused.

Thank you, so much for the support as it means the world to my family, and I.  This is not over, but it is a major hurdle in the fight for justice.  But I do have a trial ahead of me, and that is all I have asked for.  Now the truth will be told in a jury trial, to my peers.  These perpetrators now have no choice to finally tell the truth in Federal Court or suffer further perjury charges which does have consequences.

May the Lord Bless all of you in the fight against workplace bullying and other injustices at your employment?
